DOG TRAINING AGREEMENT
FOR PRIVATE TRAINING
For good and valuable consideration, the parties agree as follows:
Services and Payment: Palermo Pet Service, Inc. d/b/a BlueDog (“BlueDog”) agrees to provide private training consisting of a consultation and a series of one-hour private lessons with dog and owner. BlueDog will make every reasonable effort to help Client achieve their training goals but makes no guarantee of the dog’s performance or behavior as a result of participating in the training. Client has reviewed and agrees to follow the company’s policies, and understands that he/she and members of the household must follow BlueDog’s instructions without modification, work with the dog daily as recommended, and maintain the training being given to the dog. The Client warrants that he/she has disclosed to the trainer any behavior that may indicate that the dog may be aggressive to other dogs or people, included but not limited to growling, forceful barking, snapping, raising of hackles, lowering of head and staring, chasing, attempting to bite, and biting.
The Client agrees to pay for all scheduled sessions to BlueDog in advance, subject to the following cancellation and refund policies. The Client understands that no training sessions will be scheduled until payment is received. Travel fees will be calculated upon booking for sessions taking place in the client’s home. A handling fee of $25 will be charged on all returned checks.
For multiple session packages, the sessions must be completed within five months of purchase. Unused sessions after the expiration date will be forfeited.
Individual Session Cancellation Policy: Any request to reschedule or postpone an individual training session must be made with at least 24 hours’ notice. Cancellations made without adequate notice are not eligible for a refund. Cancellations or changes made within 24 hours of your appointment will be charged 50% of the session fee.
Travel fees: Trainers are sometimes required to travel to clients’ homes in order to conduct a training session. A flat rate of $10 is incurred for any session taking place at a client’s home within 5 miles of our facility in Lawrence, MA. An extra $5 is added per 5 extra miles from our facility in Lawrence. Mileage is determined by the fastest route and will be calculated at booking.
Termination Clause: At BlueDog ‘s sole election, BlueDog’s duties hereunder shall terminate if Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, BlueDog’s duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.
Refund policy for multi session packages: I, the Client, understand that if I decide to discontinue sessions that any refund will depend on the following conditions. Any sessions I attended will be billed at the non-discounted individual session rate. The cost of the sessions I attended will be deducted from my total package cost, in addition there is a fee of 15% of the total package cost to cover administrative and processing expenses. The cost of the attended session and additional fee will be deducted from the package price and the remainder will be refunded.
Media Release: I, the Client, hereby grant BlueDog the permission to use my likeness in a photograph, video, or other digital media (“photo”) in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all photos will become the property of the BlueDog and will not be returned.
I hereby hold harmless, release, and forever discharge BlueDog from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.
Liability Waiver: I, the Client, am aware and understand that there is always some unavoidable risk of injury involved when working with animals. I acknowledge the absolute responsibility to follow instructions, standards, guidelines and procedures established by BlueDog, its trainers, employee or agents. I am voluntarily registering to participate in BlueDog’s dog training services with the knowledge of the risks involved and hereby acknowledge and agree to assume any and all risks of injury, death, and/or property damage, whether caused by the negligence of BlueDog, its trainers, employees, or agents, or any other person.
I hereby agree to forever release, acquit, discharge, and covenant to hold harmless BlueDog, its trainers, employees, and agents, from any and all actions, causes of action, and claims on account of, or in any way growing out of, directly or indirectly, all known and unknown personal injuries or property damage which I may have or hereafter have whether attributable to the negligence of BlueDog, its trainers, employees, or agents, or any other person.
I agree to indemnify and hold harmless BlueDog, its trainers, employees and agents for all costs and expenses which they may incur due to claims or demands alleging such an injury, including settlement payments, court judgments, and legal defense fees.
This Agreement is binding upon Client, spouse of Client, and children of Client. This agreement supersedes all prior discussions, representations, warranties, and agreements of the parties, and expresses the entire agreement between Client and BlueDog regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations, or oral understandings have been made with regard to the Client’s dog or anything else. Without limiting the generality of the foregoing, Client acknowledges that BlueDog has not represented, promised, guaranteed, or warranted that the Client’s dog will never bite, that the dog will not be dangerous or vicious in the future, that the dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both Client and BlueDog.
Applicable Law: This contract shall be governed by the laws of the County of Essex in the Commonwealth of Massachusetts and any applicable Federal law.
BY SIGNING THIS AGREEMENT, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND ALL OF THE TERMS OF THIS AGREEMENT AND THAT I AM VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE COMPANY, EFFECTIVE AS OF THIS DATE.
